2019 has brought many exciting developments for our company and the hemp industry as a whole. In light of legal changes at the national level, states and regulatory agencies are beginning to grapple with the consumer demand for hemp extracts and oils. The 2018 Farm Bill legalized industrial hemp federally, allowing states to establish their own regulations and oversight of hemp production and hemp-derived products. Prior to this law, many states were already working to develop their own means of regulation through their Departments of Agriculture. As a frontrunner in the hemp industry, Utah is a prime example of this regulatory development. Following their work in 2018 to differentiate between their medical marijuana program and the industrial hemp industry, they have now implemented a flexible means of regulating the sale of hemp products while verifying their safety and reliability.
In order to best conform to this fast-growing market, lawmakers in Utah passed House Bill 3001in early December. HB 3001, titled the “Utah Medical Cannabis Act”, differentiates between industrial hemp and marijuana both chemically and in terms of state regulation. This law does away with the previous requirement of a hemp registration card for those who wish to buy hemp products. Rather than require a registration card for consumers, Utah now requires growers, producers, and distributors of hemp products to obtain a license from the state Department of Agriculture. This license ensures that products sold in state have proper third party verification, all relevant testing, andappropriate labels.This licensing process also ensures that the Department of Agriculture will have necessary points of contact with the companies doing business within their state.
This certification process is incredibly important for the validity of hemp products moving forward. A key argument brought up by the opposition is that there is not enough verification or oversight of hemp products rendering them unsafe for consumers. In states like Utah, this has been a reality for some who purchased tainted hemp products. Certifications such as the one provided by Utah’s Department of Agriculture bolster public faith in the industry and support ongoing efforts at the federal level to see hemp-derived products approved by the Food and Drug Administration (FDA).
